PARTNERSHIP AGREEMENT

BETWEEN

THE CHEROKEE COUNTY BOARD OF EDUCATION

AND

FIRST BAPTIST CHURCH OF WOODSTOCK

This agreement entered into on this 24h day of July 2013, by and between

The Cherokee County Board of Education, hereinafter referred to as the “School Board”

And

First Baptist Church of Woodstock, hereinafter referred to as “FBCW”.

WHEREAS, the School Board’s mission is to enable all students to become contributing citizens who can communicate effectively, gather and use information, make responsible decisions, utilize technology effectively, and adapt to the challenges of the future; and,

WHEREAS, one of the School Board’s Major System Priorities is to increase parental and community involvement through public engagement policies and practices that treat parents, businesses, community-based organizations and agencies, local institutions of higher learning and other public entities as true partners in the educational process; and,

WHEREAS, the School Board’s mission is to enable all students to become contributing citizens who can communicate effectively, gather and use information, make responsible decisions and adapt to the challenges of the future; and,

WHEREAS, one of the School Board’s Major System Priorities is to increase parental and community involvement through engagement policies and practices that treat parents, businesses, community-based organizations and agencies, local institutions of higher learning and other public entities as true partners in the educational process; and,

WHEREAS, the FBCW’s mission is to be a shelter of hope from which Christ's love can radiate into every life in our community and around the world.
Now therefore in consideration of the covenants and conditions set forth herein the parties agree as follows:

ARTICLE I

The parties agree that the following recitals are true and correct and incorporated herein by reference:

ARTICLE II

The School Board will:

  1. Provide the use of the school parking lots on Sundays for the purposes of shuttling FBCW attendees to the FBCW facility. FBCW will be responsible for any applicable security charges incurred by such use.

  2. Work cooperatively with FBCW officials in order to arrange for a possible bus lease agreement for FBCW shuttling purposes, adhering to conditions contained in the attached bus lease agreement, as well as the guidelines relative to leasing buses as provided by the Transportation Department.

  3. Abide by the rules and regulations contained in the facility use contract at FBCW and those contained in the FBCW’s policy relative to facility use, including custodial, utility and supervisory fees when applicable.

  4. Not discriminate against any partnership participant because of race, national origin, age or disability.

  5. Acknowledge that FBCW is a private, religious entity that is not subject to laws that public entities are subject to such as, but not limited to, IDEA Rehabilitation Act of 1973 and ADA.

ARTICLE III

FBCW will:

  1. Provide assistance to the School District relative to FBCW’s role in the School District’s Crisis Management Plan.

  2. Allow School District high schools the opportunity to rehearse and conduct graduation ceremonies at the FBCW facility. The School District shall abide by all policies and guidelines in this regard, including custodial, utility and supervisory fees when applicable.

  3. Adhere to conditions contained in the attached bus lease agreement, as well as the guidelines relative to leasing buses as provided by the School District Transportation Department.

  4. Abide by the rules and regulations contained in the facility use contract at each school facility and those contained in the Community Use of System Facilities Policy (KG), including custodial and supervisory fees when applicable.

  5. Conduct an interview with the principal of each facility prior to and after the use of the facility.

  6. Not discriminate against any participant in the School District’s off-campus pre-school program because of race, national origin, age or disability, provided FBCW shall not be required to provide more personnel or resources to accommodate the School District’s off-campus pre-school program than FBCW deems appropriate, and FBCW’s own pre-school program shall be completely separate and independent from the School District’s off-campus pre-school program.

ARTICLE IV

The term of this contract is July 24, 2013 through July 24, 2014. This contract shall automatically renew for additional terms not to exceed five years unless either party notifies the other at least 60 days prior to renewal date subject to the termination provision in Article V.

ARTICLE V

This contract may be terminated by either party upon thirty (30) days written notice to the other party with or without cause. All notice of this contract shall be given to the Superintendent of Cherokee County Schools at 110 Academy Street, Canton, Georgia 30114, and to the Associate Pastor, FBCW, 11905 Highway 92, Woodstock, Georgia 30188.
