School Properties Disposal Procedures
The Board of Education recognizes its responsibility to ensure that all property of the school system is managed, utilized, and disposed of in a manner that reflects sound stewardship, transparency, and compliance with applicable law.
The Board shall retain ultimate authority over the disposition of school system property and shall require that property determined to be no longer needed for educational or operational purposes be formally declared surplus in accordance with established procedures.
The Superintendent or designee is authorized to develop and implement administrative regulations governing the identification, evaluation, and disposition of surplus property. Such regulations shall ensure compliance with all applicable federal, state, and local laws, including any requirements related to public notice, competitive processes, documentation, and use of proceeds.
To the extent practicable, surplus property shall first be evaluated for reuse within the school system. When reuse is not feasible, the Superintendent or designee may recommend disposal through appropriate means, including sale, transfer, donation, recycling, or other methods determined to be in the best interest of the school system and permitted by law.
Real property determined by the Board to be no longer necessary or convenient for school purposes may be disposed of in accordance with O.C.G.A. § 20-2-520, Board action, this policy, and other applicable legal requirements.
The disposition of real property shall be subject to Board approval and shall comply with all applicable legal requirements governing valuation, notice, and conveyance. The disposition of personal property, including equipment and materials, shall be conducted in accordance with administrative procedures established by the Superintendent or designee.
Property acquired through specific funding sources or programs shall be disposed of in accordance with all applicable restrictions and guidelines associated with those funds. The Superintendent or designee shall ensure that appropriate internal controls, documentation, and accountability measures are maintained throughout the surplus process, including records of authorization, transfer, sale, and final disposition.
The Board further directs that all disposal activities, including those involving vehicles, equipment, or other regulated assets, be conducted in compliance with applicable statutory requirements governing identification, transfer, and use.
