PARTNERSHIP AGREEMENT
BETWEEN
THE CHEROKEE COUNTY BOARD OF EDUCATION
AND
UNIVERSITY OF WEST GEORGIA
This Agreement is made and entered into this 13th day of June, 2013 by and between
The Cherokee County Board of Education, hereinafter referred to as the “School Board”
And
The Board of Regents of the University System of Georgia, on behalf of the University of West Georgia. All obligations of the Board of Regents of the University System of Georgia under this Agreement will be performed by University of West Georgia.
WHEREAS, the School Board’s mission is to enable all students to become contributing citizens who can communicate effectively, gather and use information, make responsible decisions, utilize technology efficiently and adapt to the challenges of the future, and
WHEREAS, one of the School Board’s Major System Priorities is to increase parental and community involvement through public engagement policies and practices that treat parents, businesses, community-based organizations and agencies, local institutions of higher learning and other public entities as true partners in the educational process, and
WHEREAS, the mission of the University of West Georgia is “Educational Excellence in a
Personal Environment,” and
WHEREAS, the primary purpose of this Agreement is to provide the sequence of Cohort Program courses which will enhance the ability of Cherokee County teachers to facilitate learning and qualify for a Specialist’s in Special Education Degree.
NOW THEREFORE, in consideration of the following mutual promises, covenants, and considerations, it is agreed as follows:
ARTICLE I
University of West Georgia shall provide to do or cause to be done the following:
Provide courses in Cherokee County School District facilities for the duration of the partnership for the purpose of providing opportunities for School District staff to pursue Specialist’s in Special Education Degrees.
Provide instructional personnel.
Be responsible for enrolling participants in the courses.
Be responsible for any claims, judgments or demands occasioned by the acts of
their employees, agents or actors.Abide by the rules and regulations contained in the facility use contract at each facility and those contained in the Community Use of System Facilities Policy (KG), including utility fees.
Provide a Certificate of Insurance in an amount of not less than $1 million in limits per occurrence, naming the Cherokee County School District as Certificate Holder and as Additional Insured on a general liability insurance policy.
Ensure that program participants/students and professors adhere to the Cherokee County School District policies and guidelines relative to research and data collection that are available at District Web site under Principal’s Handbook (http://www.cherokee.k12.ga.us/Principals_Handbook/handbooksection3.htm).
ARTICLE II
The Cherokee County School System shall provide to do or cause to be done the following:
1. Provide the use of school system facilities, waiving the rental fee as per the Community Use of System Facilities Policy (KG), for professional development opportunities as coordinated by University of West Georgia.
Provide the facilities and equipment for instruction at no charge (except for a utility fee) and assume responsibility for maintenance of the facilities and equipment.
Approve degree offerings and allow for semi-annual recruitment plans for these purposes.
Dissemination of University of West Georgia information through existing communication channels, as permitted by School Board Policy.
ARTICLE III
The Cherokee County School Board and University of West Georgia will be mutually responsible for the following:
Establishment of communication during the term of the Agreement to insure the objectives of the planned courses are being met.
Neither party will discriminate against any Cherokee County School System or University of West Georgia employee or applicant for employment, or against any applicant for enrollment for a course of study at the College, or against any College student in his or her course of study or training under this Agreement solely on the basis of race, color, sex, creed, national origin, age or handicap; provided with reasonable accommodation such handicap does nothing to preclude such person's physical and mental ability to participate therein. Both parties will accept all interested participants for participation within its programs without regard to their gender, race, political affiliation, age, national origin or handicapping condition or any other discrimination recognized and prohibited by State or Federal Law. Children/participants with handicaps must be provided all necessary levels of supervision and must be included within the activities of the partnering organization. As a result of this partnership agreement, University of West Georgia must adhere to all local, State or Federal laws regarding education.
University of West Georgia will be responsible for the admission of all students/participants into its program.
ARTICLE IV
The term of this contract is June 13, 2013 through June 13, 2014. This contract shall automatically renew for additional terms not to exceed four five years unless either party notifies the other at least 60 days prior to renewal date.
This contract may be terminated by either party upon thirty (30) days written notice to the other party with or without cause. All notice of this contract shall be given to the Superintendent of Cherokee County Schools at 110 Academy Street, Canton, Georgia 30114, and the President of University of West Georgia, 1601 Maple Street, Carrolton, GA 30118.
This Agreement may be modified at any time by mutual consent of the governing bodies of the parties thereto. Any modification hereto shall be in writing and signed by both parties.
Both parties, by signatures executing this Agreement, certify that they are in compliance with the United States Drug-Free Workplace Act of 1988 and the Drug-Free Schools and Communities Act of 1989.
